Grandparents

In Pennsylvania, many grandparents have the right to petition for visitation, partial physical custody, or primary physical custody of a minor grandchild. In Pennsylvania there are three situations in which a grandparent may be granted standing to pursue custody. The first is if an unmarried parent is deceased. In order for a court to grant custody or visitation rights to the grandparent it must be determined that it is in the best interest of the child. Courts also look retroactively to the amount of contact the grandparents spent with the child before the passing of the parent.

The second scenario in which a Court may grant custody of a minor child to a grandparent is when the parents are separated or divorced. In this case the court may grant partial custody or visitation rights to the grandparents if it is in the child's best interest and does not interfere with the relationship between the parent and child. Again, the court will consider the amount of contact between the grandparents and the child previous to the petition for visitation or custody.

The final situation is when child has lived with the grandparents for twelve (12) months or more and is then removed from the home by the parents. The grandparents may petition the court for partial custody or visitation. Again, the best interests of the child will be considered and rights will only be granted if it will not interfere with the parent-child relationship.
